Sastelabel is a brand owned and operated by TOP BOY VENTURES PRIVATE LIMITED; Throughout this document, “we”, “us”, “our”, “ours”,“Sastelabel” refer to TOP BOY VENTURES PRIVATE LIMITED.  By accessing or using our services at www.sastelabel.com(Collectively, “Platform”), you agree to comply with and be bound by these Terms of Service and Conditions ("Terms"). If you do not agree with these Terms, we kindly ask that you refrain from using the platform.

We aim to offer a smooth, transparent, and secure platform for all parties involved. Please read these Terms carefully as they contain important information about your rights and responsibilities when using Sastelabel.

Buyer Terms & Conditions

1. Eligibility

By using Sastelabel, you affirm that:

• You are at least 18 years old, and

• You have the legal authority to enter into binding contracts. If you are using the platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

To use our services, you must create an account. You agree to provide accurate and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your login credentials, and any activities under your account are your responsibility.

Sastelabel reserves the right to terminate accounts that provide false or incomplete information or misuse the platform.

3. Services Provided

At Sastelabel, transparency is our middle name. Depending on the type of product listing (representative or exact), we ensure that you get exactly what was promised, with some slight variations in secondhand fashion being a normal expectation.

Scenario 1: Representative Products

In this case, the product images or videos shown are for illustrative purposes only and may not represent the exact item you will receive. While the actual product may differ slightly in appearance, colour, or condition, sellers will upload a recorded video of the exact item before shipping it to you. The order is only confirmed once you, the buyer, approve this video.

Scenario 2: Exact Products

Here, the images or videos displayed are of the actual item for sale, and this is the exact product you will receive. Due to the nature of secondhand goods, there may be slight variations in condition, color, or appearance, but these are generally minimal. In this scenario, orders are processed automatically as per our SOP (Standard Operating Procedure) after the listing has been approved by Sastelabel.

4. Order Process and Video Approval

• For Representative Products: Orders are only confirmed once the buyer approves a recorded video of the goods provided by the seller. This video is a clear representation of the product's condition and quality.

• For Exact Products: Orders are processed automatically once the buyer confirms their intent to purchase, as the product in the listing reflects the actual item to be shipped. No additional approval step is required.

• Cancellation Before Fulfillment: Buyers may cancel orders before video approval (for representative products) or confirmation of the order (for exact products). Cancellations are subject to our Refund Policy.

5. Pricing and Payments

Prices for items listed on Sastelabel are set by sellers and are displayed in Indian Rupees (INR) and other currencies. You agree to pay all applicable taxes, duties, and shipping fees associated with your purchase.

Payment processing is handled by third-party providers. Sastelabel does not store payment information and is not liable for payment processing errors or bank delays.

6. Shipping and Delivery

Sastelabel partners with trusted third-party shipping vendors for the logistics of pickup and delivery:

• Pickup from Seller: Once the buyer approves the product video (for representative products) or confirms the order (for exact products), the shipping vendor arranges the pickup from the seller.

• Delivery to Buyer: The shipping vendor then delivers the goods to the buyer's specified address.

7. Returns and Refunds

We understand that things don’t always go as planned. If there’s an issue with your order, we’re here to help!

• For Representative Products: If the product received is significantly different from what was shown in the seller's video (in terms of quality or significant discrepancies in condition), a refund may be available after a verification process.

• For Exact Products: If you receive the exact product shown but believe it differs slightly in color or condition, Sastelabel does not guarantee refunds for minimal differences due to the nature of secondhand goods. However, significant issues may still be addressed.

8. Product Quality and Discrepancies

At Sastelabel, we strive for clarity in all transactions:

• For Representative Products: Buyers are encouraged to closely examine the product video uploaded by sellers to approve the order. This is your opportunity to confirm the item’s condition and quality.

• For Exact Products: Buyers should review the product listing carefully as the images or videos provided reflect the actual product to be delivered. Slight variations in condition are part and parcel of secondhand fashion.

• Unboxing Videos: Buyers are encouraged to record unboxing videos upon receiving items. This helps speed up any potential dispute resolution processes.

. Prohibited Conduct

When using Sastelabel, you agree NOT to:

• Post false, inaccurate, misleading, or defamatory content.

• Sell illegal, counterfeit, or stolen goods.

• Violate any intellectual property rights.

• Use the platform to defraud, harass, or engage in unlawful activities.

Any breach of these rules may result in the suspension or termination of your account, as well as potential legal action.

10. Intellectual Property

All content on Sastelabel, including but not limited to text, graphics, logos, and software, is the intellectual property of Sastelabel or its content providers. You may not use, reproduce, or distribute this content without explicit permission from Sastelabel.

11. Limitation of Liability

To the fullest extent permitted by law, Sastelabel will not be liable for any indirect, incidental, or consequential damages arising from your use of the platform or any transactions made through it. Sastelabel’s total liability for any claims related to our services is limited to the amount paid for the specific transaction in dispute.

13. Changes to the Terms

Sastelabel reserves the right to modify these Terms at any time. We will notify users of any significant changes by posting an update on our platform. Your continued use of the services after such modifications will be considered as acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

Seller Terms & Conditions

1. Registration and Approval

• Sellers must register with Sastelabel and provide accurate and up-to-date information about their business. All sellers are subject to an approval process before they can list products on the platform.

2. Listing Requirements

• Product Descriptions: Each product must be accurately described, including clear indications of quality, condition, and grading based on Sastelabel's grading guidelines.

• Authenticity: While we encourage authenticity, due to the nature of bulk sales, Sastelabel cannot guarantee that each item is verified for authenticity. Sellers are encouraged to disclose any brand information responsibly and transparently.

• Quality and Condition: Only products that meet Sastelabel’s quality standards are to be listed. Clear grading guidelines should be followed to avoid discrepancies and maintain trust.

• Product Representations: If actual images of the items are unavailable, representative images can be used, but sellers must provide video verification for approval by buyers.

3. Video Verification for Representative Listings

• For listings without exact product images, a video showcasing the actual product is required. This video must be shared with buyers before order confirmation to verify quality and condition.

• Sastelabel reserves the right to audit listings that do not follow video verification requirements.

4. Order Fulfillment and Packaging

• Sellers are responsible for timely fulfillment of orders once confirmed, with appropriate packaging to prevent any damage during transit.

• Sastelabel reserves the right to mediate any disputes arising from the seller’s delay in fulfilling orders, and repeated delays may result in penalties or account suspension.

5. Returns and Disputes

• Return Eligibility: In cases where the product does not match the description or video verification, buyers may be eligible for returns. Sellers will bear the costs of return shipping for any discrepancies.

• Resolution: All disputes will first be mediated by Sastelabel. Sellers agree to comply with Sastelabel’s decision on any disputes.

6. Transparency and Honesty

• Sellers are expected to maintain honesty in all listings. Non-compliance, fraudulent practices, or misrepresentation of goods will result in account suspension or termination.

7. Payments and Fees

• Sellers will be paid based on the agreed percentage or listing fees upon the successful completion of transactions.

• Sastelabel reserves the right to update the fee structure. Sellers will be notified of any changes before implementation.

8. Compliance with Local Laws

• Sellers are responsible for complying with all applicable local laws and regulations regarding the sale and distribution of secondhand goods.

• Sastelabel is not liable for any legal issues arising from a seller’s non-compliance with laws.

9. Account Termination

• Sellers who violate any of the above terms or engage in unethical practices may face penalties or permanent removal from Sastelabel.

10. Additional Terms for Consignors

10.1. Agreement

This Agreement governs the relationship between SasteLabel (“we” or “us”) and the Consignor (“you” or “seller”) concerning all products listed on our platform and/or delivered to us for sale on a consignment basis. Upon receipt, we will review the products for eligibility and reserve the right to accept or reject items at our discretion. A confirmation detailing eligible items and their agreed-upon listing price (“Ask Price”) will be sent to you. You must notify us of any discrepancies within 24 hours of receiving the confirmation; otherwise, the terms will be deemed accepted.

By participating, you agree to fill out all required forms, including any tax-related documents, accurately and fully.

10.2. Seller Representations

You represent and warrant that:

1. You are the lawful owner of the products with full legal rights to sell them.

2. All products provided are authentic, original, and in line with the descriptions provided.

3. The products are free from any liens or encumbrances.

4. If counterfeit, altered, or otherwise misrepresented products are identified, you will bear all associated costs, including removal and replacement expenses.

10.3. Counterfeit and Damaged Goods Handling

• Products deemed counterfeit or non-compliant will be rejected.

• We will attempt to contact you twice regarding rejected items. If you fail to respond within 30 days, we reserve the right to dispose of or donate such items at your expense.

• Costs for removal and damages caused by counterfeit goods will be borne by you, and you may be debarred from listing with us for 12 months.

10.4. Sales Efforts

We will list products for sale through our platform, mobile applications, and affiliated third-party platforms. While we strive to ensure a fair selling process, we do not guarantee the sale of any product. Sellers can adjust prices upon written notice, but price increases are subject to our approval.

10.5. Proceeds of Sales

Once a product is sold, we will pay the Ask Price minus:

• A commission fee (as per our fee structure).

• Applicable payment processing charges.

Payments will only be made upon full completion of the required documentation.

10.6. Ownership and Withdrawal of Products

Ownership remains with the seller until the product is sold. Products can be withdrawn at any time by providing written notice, subject to shipping and handling fees. Early withdrawal before 30 days may incur additional charges.

10.7. Risk of Loss and Returns

SasteLabel assumes no liability for damages or losses beyond our control, including theft, fire, or customer mishandling. Sellers are responsible for insuring their products if desired.

We reserve the right to accept returns or make price adjustments for defective products in line with our return policy and applicable consumer rights laws.

10.8. Confidentiality

SasteLabel and the seller agree to maintain confidentiality regarding all sensitive information, including business details and personal seller data, except as required by law. Both parties agree to protect confidential information from unauthorized access or disclosure.
